Travel Ban
In the inaugural address, January 20, 2017, President Donald Trump promised four things
to make America great again. President Trump said, “together we will make America strong
again, together we will make America wealthy again, together we will make America proud
again and together we will make America safe again” (The White House). President Trump
wanted to keep American citizens safe from terrorist attack. On January 27, 2017, president
Donald Trump signed the executive order 13769 banning citizens from seven countries: Iran,
Iraq, Libya, Somalia, Sudan, Syria, and Yemen, from entering the United States for ninety days
also suspended U.S. Refugee Admissions Program for one hundred twenty days to enter the
United States.
The seven banned countries had been previously identified as terrorist under President
Obama and Congress. Executive order purpose and policy is to stop foreign terrorist entry into
the United States and keep American people safe. The ninety days suspension applied to
countries designated under, section 217(a)(12) of the INA, 8 U.S.C. 1187(a)(12) (The White
House), it deals with “visa waiver program for certain visitors” (U.S citizenship and immigration
service), in which Congress restricted the use of the Visa Waiver Program for nationals. The
Department of Homeland Security and Department of State will place restrictions on visas and

examine them before people from banned countries are allowed to enter the United States.
According to the U.S Extremist Crime Database, from September 12, 2001, to 2016,
there were 85 attacks in the United States by terrorists. On September 11, 2001, Osama bin
Laden attacked the World Trade Center and Pentagon. Al-Qaeda terrorist hijacked the airliner
and crashed into the Pentagon’s, Osama bin Laden was the leader of Al-Qaeda. 2969 people
were killed, more than six thousand people were wounded, and caused millions of dollars
building. In the recent years, several terrorist attacks happened in the United States. In 2013, two
Muslim brothers Tamerlan and Dzhokhar Tsarnaev, they exploded two bombs at the finishing
line in Boston Maratha, Massachusetts, killing three and injuring more than 180 people. In 2015,
Omar Mateen opened fire inside a gay nightclub in Orlando, Florida and killed forty-nine people.
This is the public concern, and wonder, Why Syria refugee got suspended to enter the
United States? In 2015, the Obama administration announced to resettle 10,000 Syria refugees in
the United States. The terrorist attacked in Paris killed 150 people, “FBI suspected one of the
attackers who enter in Europe as a refugee” (Ashely Gold and Paul Blake). That was the reason

why the U.S begin to concern about the refugee entry into the United States. Speaker of the
house of Representative Pual Ryan called for a “pause” in the US refugee program. He tweeted,
“Our nation has always been welcoming, but we can’t let terrorists take advantage of our
compassion” (Ashely Gold and Paul Blake).
President Trump signed the second executive order on March 6, 2017, but didn’t utilize to
anyone until March 16, 2017, a minute pass from Midnight. After that day, the first executive order
didn’t work anymore. The second executive didn’t mean to an extension the ban period, but it
revoked and replaced the first executive order. The Trump administration enhanced the restriction
rules on banned countries. The new execute order 13780 reinstated the ninety-day suspension of
entry for nationals from six countries, eliminated Iraq from the list, but kept Iran, Libya, Somalia,
Sudan, Syria, and Yemen. The government of Iraq and State Department had negotiated, the Iraqi
government said, they will enhance the cooperation with the U. S on the vetting of its citizen
applying for a visa to travel to the United States (Department of Homeland Security). When they
check the data, the result of information sharing has increased, Iraqi citizen isn’t affected by the
second executive order.
The court’s move is “a substantial victory for the safety and security of the American
people,” Attorney General Jeff Sessions said in a written statement. “We are pleased to have
defended this order and heartened that a clear majority Supreme Court has allowed the
President’s lawful proclamation protecting our country’s national security to go into full effect.
The Constitution gives the President the responsibility and power to protect this country from all
threats foreign and domestic, and this order remains vital to accomplishing those goals.”

On September 24, 2017, President Trump second executive order expired. The Trump
attempted to ban the travel again and it’s known as proclamation 9645 of September 24, 2017. Its
purpose to enhance the second execute order restriction rules and regular and investigate the
processes attempted entry into the United States by terrorists, other public safety threats,
suspended and limited, subjects to exceptions, and case-by-case waivers. The proclamation 9645
doesn’t mean to suspend the countries as executive orders but ban them with no expiry date.

Amendment’s establishment clause because the executive order ban citizens from seven Muslimmajorities and Christian refuge’s, and (2) violate the constitutional right to due process and
contravenes the federal Immigration and Nationality Act. (3) The executive order violent first

response the complaint from the State of Washington and said an executive order is the

What has the change in second and third travel ban?
On January 30, 2017, the state of Washington filed a complaint in the U.S district court
seeking declaration and injunctive relief against Defendants Donald Trump, and Department of
Homeland Security. A preliminary injunction to prevent section 3 for the ninety days ban, and
section 5 for refugee’s admission prohibit. Section 3 is the legal basis for providing jobs for
residents and awarding contracts to businesses in areas. Section 5 is the enforcement priorities.
The executive order purpose is to protect U.S citizen from terrorist attacks, including its resident,
employees and illegal action of the president. On January 31, 2017, the states of Washington
filed an amended complaint adding the state of Minnesota as a plaintiff. The complaint about the
President’s Executive Order is “separating the Washington families, harming thousands of
Washington residents, damaging Washington’s economy, hurting Washington-based companies,
and undermining Washington’s sovereign interest in remaining a welcoming place for
immigrants and refugees” (United States district court western district of Washington). In the
support, Amazon and Expedia claim that the Executive Order impacts their operations and their
employees.
The state of Washington added some evidence that the Executive Order is harming them:
(1) According to the American Community Survey data from the U.S. Census Bureau, as of

2015, approximately 7280 non-citizen immigrants from Iran, Iraq, Syria, Somalia, Sudan, Libya,
and Yemen reside in the State of Washington: 409 Iranian immigrants, 2,275 Iraqi immigrants,
360 Libyan immigrants, 2,883 Somalian immigrants, 165 Sudanese immigrants, and 187 Syrian
immigrants. (2) In Washington, immigration is an important economic driver. Many workers in
Washington’s technology industry are immigrants, and many of those immigrant workers are
from Muslim-majority countries. In Washington, immigrant and refugee-owned businesses
employ 140,000 people. (3) Many companies in Washington are dependent on foreign workers
to operate and grow their businesses. (4) The two largest public research universities in the
Washington: The University of Washington and Washington State University. More than 95
students from the suspended countries attend the University of Washington, based in Seattle and
more than 135 students from those countries attend Washington State University, based in
Pullman. (5) Washington residents will be prevented from being reunited with their family
members. One Syrian family who recently resettled in Seattle is waiting for an older child still in
a refugee camp who was set to arrive in the United States because of the Executive Order.
The federal dependents opposed state of Washington. What is parens patriae? It is the
power of the state to act as guardian for those who are unable to care for themselves, such as
children or disables individuals but in recent, law added care of resident. A state cannot sue the
Federal Government on a parens patriae theory. The federal dependents response the state with
some evidences: (1) The State’s attempts to manufacture standing in its own right—i.e., through
lost tax revenues, or reputational injury to its universities are not concrete, particularized harms
cognizable under Article III of the U.S constitution. Many of the State’s claimed harms but
simply harms do not exist because the State cannot rely on injuries to lawful permanent residents
plus the White House clarify that the 90-days suspension of entry does not apply to permanent

residents. (2) an alien seeking initial admission to the United States requests a privilege and has
no constitutional rights regarding his application, the power to admit and exclude aliens are a
sovereign prerogative. (3) The State didn’t prove the executive order is not constitution at all
plus didn’t ask a question of lawful application. For example, alien with non-resident. I.e., the
State’s facial challenge necessarily must fail.
The state of Washington said that the executive order against the first amendment,
freedom of religious. The district court agree with the claim and ask the question to federal
dependents why executive order ban the individual’s citizens from seven countries to protects the
citizens of the United States? Federal dependents said, the suspended citizens from the seven
countries had been previously identified as terrorist under Obama and Congress: area of concern
and with respect to the terrorism. Iran, Syria and added Sudan in 2017 are under the Congress
restriction and rest of the them are under the executive branch of Obama administration.
Therefore, the Executive Order 13769 doesn’t say anything new about these being countries of
concern as a terrorist (Pam Martens and Russ Martens).

Consequences of Donald Trump Travel Ban
The travel ban issued by president Donald Trump on certain foreign nations will have
dire consequences on the nation. The president issued the travel ban in the wake of terrorist
attacks and sought to address the issue of foreigners and their roles in the attacks. The president
banned nations such as Sudan, Iraq, Libya, Iran, Yemen, Syria, and Somalia. The countries were
banned from entering United States soil for a period of 90 days. The administration claimed that
the move will enable them to set up strong vetting standards to prevent terrorists from entering
the country and ensure travel security. The move has an impact on the nation and is not to be
taken lightly. The ban has chilling consequences on the country’s business with the outside
world, student engagement with universities, and tourism.
The country’s global business will have to bear consequences of the travel ban. The ban
affects the business persons and corporations. Visa holders from the seven countries will get
affected by the ban. This affects the businessmen who will have to cancel or reschedule their
business trips to the United States. The immigration and non-immigration people who hold visa
are all barred from entering the country and if most of these individuals hold several businesses
and are from Iraq, they will have to cancel their trips and wait. The impact will also be felt with
the businesses they are to attend as those businesses in the United States will get forced to incur
more cots for rescheduling the meetings. An example is when the Emirates Airline which is
Dubai-based, had to adjust their employees’ schedules on the flights that are the U.S bound. They
did so to comply with the president’s orders. The airline’s stocks plummeted more than 4% in the

ban’s wake. The financial impact was felt on the airline. It is, therefore, one of the consequences
of the travel ban (Melanie 2017).
The industries which have a diverse workforce will also be victims of the travel ban.
Most of the industries in the technology and the healthcare will be affected by the presidential
order. Th effect they will feel is the decline in the number of foreign workers after a few years.
Most of the employees form the seven mentioned countries will have to change plans and the
industries will also have to search elsewhere for employees and resign to losing their best talents.
In the news outlets, there was a report that close to 200 Google employees hail from the seven
nations named in the ban. The company’s CEO Sundar expressed concerns on the acquisition of
talent to the United States (Doug 2017).
Students from the universities locally will also get affected by the ban. Most students
will feel discouraged to enroll in the United States university programs. The uncertainty will fuel
their discouragement since they aren’t sure whether the country itself will accept them at the
airports. Therefore, they will have to look elsewhere for higher learning studies. The available
foreign students in the country whose country of origin is mentioned will get impacted by the
travel ban. They will now have to stay put in the country until the storm weathers off which may
take quite a while. They will also have to wait until the matter has some clarity.
The ban will have an impact on the country’s tourism status. Currently, tourism
contribution to the GDP of the country is at $503.7 billion (World Travel and Tourism, 2017)and it is at stake due to the ban. Analysts have projected that the ban may punch a $1.8 billion
hole to the country’s tourism status. Foreign tourism is crucial to the country since it contributes
$250 billion annually. The ban saw a decline in the airline and hotel bookings ever since it came
to effect. Now there are 4.3 million travelers whose number reduced significantly this year due to
